2. About Our Services

Opulent Agency is a model and talent management agency based in Sydney, New South Wales, Australia. We provide talent representation, casting, booking, and management services to clients across Australia and internationally. Our services include but are not limited to fashion and editorial placement, runway representation, commercial casting, digital content management, talent development, and event staffing.

3. Use of the Website

You agree to use this Website only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Website. Prohibited conduct includes:

  • Using the Website in any way that breaches any applicable local, state, national, or international law or regulation
  • Transmitting any material that is defamatory, offensive, or otherwise objectionable
  • Using automated systems (bots, scrapers) to access the Website without our prior written consent
  • Attempting to gain unauthorised access to any part of the Website or its underlying systems

5. Talent Booking Terms

All talent bookings are subject to the following conditions:

  • Confirmation: A booking is only confirmed upon receipt of a signed booking agreement and any required deposit payment.
  • Cancellation by Client: Cancellations made more than 7 business days prior to the booking date will receive a full refund of any deposit. Cancellations within 7 business days incur a 50% cancellation fee. Cancellations within 48 hours incur the full booking fee.
  • Cancellation by Agency: In the unlikely event we need to cancel, we will provide a suitable replacement talent or a full refund at the client's discretion.
  • Usage Rights: Usage rights for images and content produced during bookings are as specified in the individual booking agreement. Any usage beyond the agreed scope requires additional licensing.
  • Payment Terms: Unless otherwise agreed in writing, payment is due within 30 days of invoice date. Late payments attract interest at 2% per month on the outstanding balance.

6. Talent Representation Terms

Talent represented by Opulent Agency are subject to individual representation agreements. Key terms include:

  • The agency operates on a commission basis; no upfront fees are charged for representation
  • Commission rates are specified in individual representation agreements
  • Represented talent must not accept bookings independently that fall within the scope of their representation agreement
  • Talent must maintain professional standards of conduct, appearance, and punctuality at all bookings
  • Either party may terminate the representation agreement with 30 days' written notice

7. Limitation of Liability

To the maximum extent permitted by law, including the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)):

  • We do not exclude any consumer guarantees that cannot be excluded under Australian law
  • Our liability for breach of any non-excludable consumer guarantee is limited, at our option, to the re-supply of services or payment of the cost of having services re-supplied
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Website or services
  • Our total aggregate liability to you for all claims arising from or related to our services shall not exceed the total fees paid by you for the specific service giving rise to the claim

8. Indemnification

You agree to indemnify and hold harmless Opulent Agency, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, your use of our services, or your violation of any rights of a third party.
